Dispatchers are classified as public employees and, as such, they should be fully aware of the definitions of untruthfulness and the consequences of it they have been found to have “lied” in the performance of their duties. This course is designed to fully inform and educate dispatchers on the “truthfulness issue” especially in light of recent case law and the current state of affairs in the public safety arena.

Specifically, this (4) hour course will cover the following subject matters;

  • Dispatchers considered public employees just like police officers
  • Definitions of untruthfulness
  • Examination of criminal statutes that address untruthfulness to include perjury, filing a false police report, and misleading a police investigation
  • Differences between lying and allowable ruses
  • Policy considerations for Untruthfulness
  • Significance of the United States Supreme Court case of Brady v. Maryland
  • Consequences of untruthfulness as a result of the Massachusetts Supreme Judicial Court decision in City of Pittsfield v. Local 447 IBPO (2018)
  • Dispatchers as part of the “prosecution team” and the significance of the Massachusetts Supreme Judicial Court opinion in CPCS v. Attorney General’s Office (2018)
  • The wide scope of untruthfulness and the significance of the Massachusetts Supreme Judicial Court decision handed down entitled In the Matter of a Grand Jury Investigation (2020)
  • The “Brady List Protocol” (Rule 14 of the Massachusetts Rules of Criminal Procedure) (2022) and the impact on dispatcher performance
  • The different Brady List Procedures in the various District Attorney’s Offices throughout the Commonwealth
  • Possible procedures to challenge placement on a Brady List
