This seminar will incorporate a thorough presentation of many of the significant problems that exist with one of the most important positions within a police agency- The police prosecutor.

Some of the issues that will be thoroughly addressed include:

 

Ø  Management’s Right to Assign Prosecutorial Duties

Ø  The powers of the police prosecutor and court liaison personnel

Ø  What can be done to assist the ADA, criminal and motor vehicle appeals to the Magistrate (and then further to the judge),

Ø  Clerk-Magistrate Hearings – Public or Private?

Ø  Criminal Complaint “Redetermination” Hearings

Ø  Felony charges sought by law enforcement officers – no right to a hearing

Ø  What police records can be withheld from public inspection versus information contained in the court files.

Ø  The different standards of probable cause

Ø  What dispositions are permissible?

Ø  Double Secret “Clerk-Magistrate” Probation

Ø  Untruthfulness & the “Brady List”
