Hon. Elspeth B. Cypher (ret.) served as an Associate Justice on the Massachusetts Supreme Judicial Court from 2017 until January 2024. She served on the Massachusetts Appeals Court from 2000 to 2017. She received a B.A. from Emerson College in 1980 and a J.D. from Suffolk University Law School in 1986, where she served on the Suffolk University Law Review. She worked in a small general practice and as prosecutor. She has extensive teaching experience, most recently as the Huber Distinguished Visiting Professor at Boston College Law School. She is a frequent panelist for the National Cybercrime Conference. She is the current author of the Massachusetts Practice Series, Criminal Practice and Procedure, Volumes 30, 30A, and 30B.
The seminar will run from 9:00 a.m. – 1:00 p.m.

This class will cover everything you need to know about the law in Massachusetts concerning self-incrimination, the right to remain silent, custodial interrogation, due process, voluntariness, Miranda warnings and waivers, Miranda exceptions, the Fifth Amendment right to counsel contrasted with the Sixth Amendment right to counsel, house of corrections interrogations, testimonial evidence, spontaneous utterances and the confrontation right, use of deception or misdirection, recording statements, scope of questioning, consent, and recent case law updates.
